CWP 6233/2008 filed in Punjab & Haryana High Court stands disposed of. The court rejected the claim of PSU bank pensioners/familhy pensioners for enhancement of pension upon each Bipartite Settlement(BPS). The main point relied upon by the Union of India (Respondents) and upheld by the Single Judge is that there is no SPECIFIC provision in Bank Employees\` (Pension) Regulations for enhancement of pension upon each BPS. However, what the learned Judge and also the Under Secy./Dy.Secy. of Finance Ministry, Union of India (Respondents) failed to consider is HOW & UNDER WHICH SPECIFIC RULE OF CCS (PENSION) REGULATIONS APPLICABLE TO THEM, their ex-colleagues in Central Govt. are being paid enhanced pension upon submission of each Pay Commission Report (because, there is no specific provision in CCS Pension Rules for the same) . However, in Bank Employees\` Pension Rules, there is a specific provision which states that in case of doubt/clarification, regard shall be had to CCS Pension Rules. So, my argument is the practice prevalent in Central Govt. should be made applicable to Bank Employees Pensioners/family pensioners also.
